Pirate Bay lawyers demand retrial

Lawyers for four men jailed for running The Pirate Bay file-sharing website are calling for a retrial, saying the judge could have had a conflict of interest.

Judge Tomas Norstrom is a member of the Swedish Copyright Association and sits on the board of Swedish Association for the Protection of Industrial Property.

But the judge has told Swedish Radio: "These activities do not constitute a conflict of interest."

Sweden's Court of Appeal would rule on a possible retrial, the lawyers said.

Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom and Peter Sunde were found guilty of breaking copyright law on 17 April 2009 and sentenced to a year in jail.

The four were also ordered to pay $4.5m (£3m) in damages to a number of entertainment companies, including Warner Bros, Sony Music Entertainment.

Microsoft, Yahoo Seek Common Ground through Display ads

This would likely be part of a broader collaboration that includes the much-larger search advertising market, where Yahoo and Microsoft trail far behind rival Google Inc. (GOOG).

The new wrinkle is tacit recognition the two companies have far more to gain by joining forces to battle Google than they stand to give up in terms of independence or control. Microsoft has a tiny share of both search and display advertising, but has the resources, technical capacity and will to take on Google because the company's ubiquitous software is the way many users will access Internet search.

And despite all its problems, Yahoo has an Internet brand that few companies can hope to match. It is still the largest player in the display advertising market.

Whether the two sides can cut a deal remains an open question. Since Microsoft's $47.5 billion unsolicited takeover offer collapsed last May, the relationship between the two companies has been guarded at best. Relations have thawed since co-founder Jerry Yang surrendered stewardship of Yahoo to Bartz in January. Investors, many of whom feel taking on Google individually is near impossible, are pushing the companies to collaborate.

Andrew Frank, an analyst at research firm Gartner, said a partnership between the companies would allow them to get the best of each others' businesses and technologies, while preventing needless duplication and competition. Some disciplines, like advertising sales, would naturally fall to Yahoo. Microsoft could better focus on its strengths like helping Internet publishers manage ad inventory.

Of course, a display deal wouldn't be a silver bullet for either company. Display advertising is less than a fifth of the $23.6 billion market for Internet advertising in the U.S. The big money is made in search advertising and the lion's share of it is being made by Google.

Still, a display deal may pave the way for a larger collaborative relationship that resolves both companies' thorny search problems.

Microsoft ordered to pay $388 million

 Microsoft Corp (MSFT.O) was ordered to pay $388 million in damages for infringing a patent held by anti-piracy software maker Uniloc Inc on Wednesday.

Microsoft, the world's largest software maker, said it was disappointed in the verdict, and plans to appeal.

The verdict was reached by a jury in a long-running case in federal court in Rhode Island, which found that Microsoft infringed Uniloc's patent on software that generates unique identities for licensed users and prevents unauthorized use or copying of programs.

"We believe that we do not infringe, that the patent is invalid and that this award of damages is legally and factually unsupported," said a Microsoft spokesman. "We will ask the court to overturn the verdict."

Uniloc USA and its Singapore-based parent originally filed suit against Microsoft in 2003, claiming that Microsoft infringed its patent with security software it was using to prevent unlicensed use of its Windows XP operating system and parts of its Office suite of products.

After six years of legal wrangling, the jury trial started in March. The damages award is one of the largest on record in patent law disputes.

U.S economy sheds 663,000 jobs

The U.S. unemployment rate soared to 8.5 percent in March, the highest since 1983, as employers slashed 663,000 jobs and cut workers' hours to the lowest on record, government data showed on Friday.

In a report underscoring the distress in the labor market, the Labor Department also revised its data for January to show job losses of 741,000 that month, the biggest decline since October 1949.

The drop in non-farm payrolls in February was unrevised at 651,000.

U.S. equity futures and government bond prices fell and the U.S. dollar rose against the yen after the data.

The report, coming in the wake of recent data that have surprised on the upside, did little to alter perceptions the economy's downward momentum was slowing as unemployment was a lagging indicator and tended to peak well after the recession ended, economists said.
